Trained as a complex commercial litigator at some of New York’s most prestigious law firms, Michelle Foxman represents high net worth clients in all areas related to matrimonial and family law. Michelle’s experience litigating high stakes contract disputes has proven indispensable to her matrimonial practice, in particular when advising clients seeking to enforce or overturn prenuptial agreements or settlement agreements. For example, Michelle achieved success at the trial court level by creatively advocating for a particular interpretation of a term in a prenuptial agreement on behalf of a client who sought to invalidate the agreement as a whole. 

Michelle’s high EQ enables her to establish a strong rapport with each of her clients, which in her view is vital to litigation strategy and successful advocacy. Whether Michelle is litigating complex financial asset division, child support, spousal maintenance, or custody disputes, or negotiating a settlement, Michelle’s clients value her empathy, tough love, and wit during a taxing time. Michelle’s ability to reframe challenges during litigation helps her clients abandon “black and white” thinking and understand available paths toward a resolution. Michelle is particularly skilled at guiding clients through highly charged custody disputes, including those involving issues of mental health challenges, substance abuse, and domestic violence. 

Michelle began her career out of law school as a commercial litigator at Cravath, Swaine & Moore LLP and later continued her commercial litigation practice at Selendy Gay PLLC. While at Selendy Gay, Michelle represented a commercial developer in a breach of contract suit against a real estate lender, a subordinated lender defending against senior lenders’ fraud and breach of contract claims, and a well-known film producer in a breach of contract dispute with an art gallery over a Jeff Koons sculpture. Earlier in her career, Michelle litigated copyright and trademark suits on behalf of high-end fashion houses, luxury goods companies and musical artists. After Selendy Gay, Michelle joined the prestigious matrimonial firm, Cohen Clair Lans Greifer Thorpe & Rottenstreich, where she worked with Dan Rottenstreich and John Farley, and devoted one hundred percent of her practice to matrimonial and family law. 

Michelle has been recognized by her peers for excellence in her practice of family law. She was selected for inclusion in Best Lawyers ® in America for 2024 and 2025, and for inclusion in Marquis Who’s Who in America. 

Michelle received her JD, magna cum laude, from New York University School of Law where she was elected to Order of the Coif, was an editor of the Journal of International Law and Politics, and directed, choreographed and performed in the annual Law Revue show. She received her BA, cum laude, from Columbia College in Comparative Religion. 

Michelle lives in Manhattan, is an avid theatergoer, a Stephen Sondheim fanatic, and enjoys Olympic weightlifting. Michelle has three adult children who will always represent her best work.
